See our advice on cohabitation agreementsAre prenuptial agreements legally binding?
Prenuptial agreements are not automatically legally binding in England and Wales. However, since the Supreme Court decision in Radmacher v Granatino, courts will usually uphold a prenup if it was freely entered into, with full understanding, and is fair.
