Family disputes involving more than one country can present complex legal challenges.
Our international family law specialists advise clients on cross-border issues including international child abduction, overseas relocation, leave to remove children from the jurisdiction and the recognition of foreign court orders.
We work with clients facing jurisdictional disputes and international enforcement issues, providing clear guidance through what can often be highly complex proceedings. Our aim is to find practical solutions while protecting our clients' rights and the welfare of any children involved.
We advise on:
If you need to agree where your children live and the time they spend with each parent, we can help you reach an arrangement or apply to court.
If you are divorcing and one of you lives abroad, we can advise on the process in England and Wales.
What should I do if my child has been taken abroad without my consent?
Act quickly. If your child has been taken to a country that has signed the 1980 Hague Convention, you can apply for their return. Contact a solicitor as soon as possible, as delay can affect the outcome.
Can I move abroad with my child?
You need the consent of everyone with parental responsibility, or permission from the court. Taking a child out of the UK without this can amount to child abduction.
Can I take my child on holiday abroad?
If there is a child arrangements order saying your child lives with you, you can usually take them abroad for up to one month without the other parent's consent. Otherwise, you need the agreement of everyone with parental responsibility.
