Finances and children after divorce

A divorce ends the marriage, but it does not settle your financial ties. Without a financial order, your former spouse could still make a claim in the future. It is usually wise to resolve finances before applying for the final order, particularly where pensions are involved.

If you have children, we can help you agree where they will live and how much time they spend with each parent.

Frequently Asked Questions About Divorce in England & Wales

What are the grounds for divorce?

Since April 2022, divorce in England and Wales is based on “no-fault divorce.” Under the Divorce, Dissolution and Separation Act 2020, you only need to state that the marriage has irretrievably broken down. You do not have to blame your spouse.

How long does a divorce take?

The process usually takes a minimum of 26 weeks (around 6 months):

  • 20-week reflection period between application and Conditional Order
  • 6 weeks between Conditional Order and Final Order

Complex financial matters can extend the overall timeline.

Do we have to go to court?

Most divorces are handled online through HM Courts & Tribunals Service and do not require a court hearing unless there are disputes about finances or children.

Can we apply jointly?

Yes. Couples can make a joint application under the no-fault system, which can help maintain a cooperative approach.
